If this comes to pass, not only has the shark been jumped, it has been landed on, pummeled, and its bloody carcass laid bare for all leap over. Weak sauce indeed.

Why? It makes perfect sense to trademark the name and to expand his enterprise, especially given the recent and forthcoming changes in state laws for both medical and recreational use. There is certainly some subset of his fanbase that would appreciate it.

If Margaritaville doesn't file this type of trademark protection for the words "coral reefer" then the term isn't .... protected.

And someone else will use those words in association with e-cigs, hookahs, etc. etc.

Sounds like it won't fly unless it's meant specifically for marijuana use. That may work if he targets markets where it's legal and/or decriminalized. To me, the term "Coral Reefer" was never ambiguous as it's never been a secret that it was a direct reference to weed. While Buffett may not be as outspoken about it as Willie, as recently as just a few years ago he openly admitted in a Rolling Stone interview that he still likes to smoke marijuana on occasion. It's also something he's never shied away from in concert or in his songs. While some may prefer a toned down, palatable to the masses version of Buffett, I never have. I'm not sure about now but I'd say a large majority of his original following from the 70's were unadulterated stoners and certainly not a "subset" of his audience. Then again, that was back when he had more of a cult/underground following.

I'm only 30 yeArs old and I'd like to think I'm still pArt of the cult/underground following. Even with all the business, commercialism - jimmy is still the tequila drinking pot smoking folk singer. I know I'm a minority these days but no one writes a song better than JB. I wish at times he knew how much he is worth, in a songwriting sense. He is one of the best American song writers of our time. My wife alwAys tells me I shoulda been in the 70s.

I can think of several right off the top of my head: Mike Cooley, Guy Clark, John Prine and James McMurtry. Buffett in his prime was worthy of mention as a songwriter but that ship sailed a very long time ago. He hasn't displayed that sort of prowess in quite some time now. He's become more of a cover artist, especially in concert which is sad to see. He started with a great deal of promise and was able to deliver on that for quite a while.

In my opinion, that's not even close to being true. The Jimmy Buffett I became a fan of many years ago was a musician who later had some business interests on the side. The one out there now is a businessman who dabbles in music. It obviously worked out pretty well for his investment portfolio but, again, in my opinion, the music has suffered.

I agree. He peaked with Cheeseburger in Paradise. All that time in the boardroom has sullied any chance of that level of musical brilliance ever surfacing from Jimmy's mind again. Will there ever be another Off To See The Lizard. Sadly, no. Bob Roberts . . . Desdemona Building a Rocket Ship, Mental Floss? As brilliant as Banana Wind was in its entirety that ship has sailed. But really, Earl's Dead is on par . . . . Perhaps there is hope.

Yep. I'd wager that it's solely to stop others from using the name, and not an indication that Margaritaville intends to sell any product of the sort.

MARGARITAVILLE - CHEESEBURGER IN PARADISE - CARIBBEAN SOUL - LANDSHARK - FIVE O'CLOCK SOMEWHERE (with Alan Jackson)
Words or phrases that Jimmy coined (literally) in song lyrics. All eventually became associated with some sort of marketable product or business venture.
But that's just the tip of the iceberg, Jimmy has trademarked hundreds of phrases associated with his songs.

The cynic in me wonders if *corporate Jimmy* sometimes co-writes lyrics with *songwriter Jimmy* when he puts pen to paper and writes a song.

Why do I think that? Shown below is a short list of song lyrics (and more) that Jimmy has trademarked (SOURCE http://www.uspto.gov/sitesearch.jsp). Some are no longer active trademarks. Some have not (yet) been used in any commercial products or advertising. But many you will recognize as being associated beyond the original song lyric.

It goes well beyond his most famous "brand" word of just "MeglaritaMart" ... sorry ... I meant "Margaritaville". 8)

Jimmy is also extremely protective of his brand (as he should be). His lawsuit and eventual settlement with Chi Chi's Restaurants over the use of the word "Margaritaville" on their menus is considered to be a "textbook case" of artist rights to their image and is cited all over the web by law firms giving examples of trademark protection. (source: http://www.txpd.org/TPJ/18/song_same.htm)

But Jimmy also has attempted to capitalize on someone else's famous phrases. Remember Charlie Sheen's famous meltdown? Of course you do. Jimmy pulled a 180 degree turn of thought in that situation and MARGARITAVILLE ENTERPRISES, INC. decided to capitalize on Charlie Sheen by trademarking the name TIGER BLOOD as a Vodka Energy Drink.

There's probably more but Buffett didn't "coin" "landshark". It first appeared as a skit on Saturday Night Live in 1975, at least to the best of my knowledge. Buffett definitely wasn't the first to come up with it. While he has every right to legally protect some of the phrases he is responsible for (such as "Margaritaville"), the fact that he would go to such lengths to legally trademark all of the ones listed above makes my stomach turn. He's never made any secret of the fact that he's more of an entertainer and a businessman than a musician but I believe he crossed a line here. The amount of greed on display is downright disgusting and sickening.

We're gonna have to enter after each song in the next setlist.

Well, each song that's actually a Buffett song and not a cover song...

I couldn't care less about this and I don't know a thing about trademark law some maybe someone can explain. How does one take a couple common words and trademark it? It's like I could trademark the phrase "baseball bat" and nobody could touch it. BTW, the first time I heard landshark was in a the movie K9 with James Belushi when he referred to a German shepherd as a landshark. Margaritaville is a different story as it is an invented word. Just curious.

"Landshark" is also an "invented word", one Buffett himself didn't come up with. It's obvious, especially if you listen to the banter on You Had To Be There that he was a huge Saturday Night Live fan and that in all likelihood his "sharks that can swim on land" line from "Fins" was inspired by the original SNL skit. There's a brief history of the skit here.
